Terms and Conditions of Maritime Shipping Service
Effective Date: August 8, 2025

Scope of Service

 

Santiago Cargo Express Corp. (“the Company,” “we,” or “our”) provides marine cargo shipping services only. We do not offer air shipping or courier services. All shipments are transported via ocean freight with door-to-door delivery, unless otherwise agreed.

Cargo Acceptance and Delivery

 

  • All cargo must be properly packed, labeled, and declared at the time of drop-off or pickup.

  • Upon arrival at destination, the consignee must sign a delivery form confirming receipt.

  • Once the form is signed, no claims will be accepted for damaged or missing items.

  • Cargo will be stored in our warehouse for a maximum of 90 days. After this period, it will be considered abandoned and may be discarded without prior notice.

Payment Terms

 

  • We only accept cash or Zelle as payment.

  • Full payment must be made before or at the time of cargo drop-off.

  • If payment is not received within 15 days of the cargo's arrival at the destination port, a 10% storage fee will be applied every 15 days, based on the shipping cost.

  • After 90 days, if no payment is received, the cargo will be considered abandoned and auctioned off.

Limitation of Liability

 

In the event of loss or damage:

  • New undeclared items will be compensated at current market value minus 15%.

  • Used items will be compensated up to 25% of estimated value.

  • Items with no commercial value will not be compensated.

  • The Company is not responsible for delays caused by weather conditions, port congestion, customs inspections, or events beyond our control.

Packing and Declarations

 

  • Large Boxes or Barrels (over 18” x 18” x 18”): New items must be declared. Documents, titles, or copies will not be accepted in non-commercial shipments. We reserve the right to inspect and record the contents to ensure safety and compliance.

  • Fragile or Glass Items: We are not liable for broken glass, mirrors, or similar items unless properly protected and declared.

  • Vehicles: Must be delivered to the port with a quarter tank of gasoline.

Shipping Delays

 

  • Vehicles: Are delivered to the port within 72 hours of receipt. Customs inspections typically take 5 to 10 business days. We are not responsible for delays caused by customs or port authorities.

  • General Cargo: Estimated delivery time is 3 to 4 weeks. We are not responsible for delays due to:

    • U.S. or destination country customs or security inspections

    • Natural disasters

    • National strikes

    • Customs delays

Prohibited Items

 

The following items are strictly prohibited in any box or container. Shipping any of these items may result in seizure, fines, disposal, and/or denial of service:

 
Illegal or Controlled Substances
  • Narcotics, marijuana, cocaine, heroin, or any controlled drugs

  • Drug-related paraphernalia or trafficking materials

Weapons and Explosives
  • Firearms (including parts), ammunition, tasers

  • Explosives, fireworks, flammable materials

  • Military or tactical equipment

Hazardous Materials
  • Chemicals, solvents, pesticides, corrosive substances

  • Gasoline, propane tanks, flammable liquids

  • Undeclared or improperly packed batteries (especially lithium)

Counterfeit or Copyrighted Goods
  • Fake brand items, pirated products, or unlicensed merchandise

  • Excessive quantities of perfume

Currency and Valuables
  • Cash, coins, checks, or money orders

  • Jewelry, precious metals or stones, negotiable documents

Perishable or Biological Items
  • Food that is not canned, sealed, or preserved

  • Canned pet food

  • Live plants or animals

  • Human or animal remains, including ashes

Technology and Surveillance Equipment
  • Drones, GPS trackers, hidden cameras, or spy equipment

  • Any item restricted by the destination country's import laws

Personal or Government-Issued Documents
  • Passports, birth certificates, driver’s licenses

  • Immigration documents or sensitive personal records

Other Restricted Items
  • Used tires, mattresses, open furniture

  • Pornographic or obscene materials

  • Alcohol and tobacco (unless legally declared and approved)

  • Any item prohibited by customs or maritime regulations in the destination country

Inspection and Compliance

 

  • All shipments are subject to inspection by Company staff, customs, and port authorities.

  • We reserve the right to open and inspect any cargo.

  • If a violation is found, the cargo may be rejected or returned at the sender’s expense.

Claims and Disputes

 

  • Claims for damage must be submitted before signing the delivery form.

  • Claims made after signing will not be accepted.

  • All claims must be submitted in writing and include photos, receipts, or other supporting documents.

Governing Law

These Terms and Conditions are governed by the laws of the State of New York. Any disputes shall be resolved in the competent courts located in New York.
